1. INTRODUCTION
These Terms of Service (“Terms”) govern your access to and use of Quizzory, operated by SurveyHeart LLP (“Quizzory”, “we”, “us”, or “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must stop using the platform.
2. DEFINITIONS
• “User” – any person who creates an account on Quizzory.
• “Quiz Creator / Customer” – the User who designs quizzes, assessments, tests, competitions, or collects quiz answers.
• “Participant / Respondent” – any person who attempts or submits a quiz.
• “Data Fiduciary / Controller” – the User responsible for determining the purpose of data collection.
• “Processor / Service Provider” – Quizzory, processing data solely under User instructions.
• “Services” – all features offered by Quizzory, including quizzes, assessments, competitions, templates, analytics, APIs, and add-ons.
3. ELIGIBILITY & ACCOUNT REQUIREMENTS
You must be at least 18 years old to create a Quizzory account (to be a Quiz Creator). Participants may be younger than 18 where the Quiz Creator has obtained the parental or guardian consent required by applicable law. You agree to provide accurate information and maintain the confidentiality of your account credentials. You are responsible for all activities under your account.
4. DESCRIPTION OF SERVICES
Quizzory provides tools to create, distribute, conduct, and analyze quizzes, assessments, tests, competitions, learning activities, templates, analytics, and related digital content. We also offer paid subscriptions, add-ons, and APIs.
5. DATA PROTECTION & PRIVACY
Your use of Quizzory is governed by the Quizzory Global Data Privacy Policy as published on our website. By using the platform, you consent to our data practices, including processing and storage in India.
Roles:
• Quiz Creators are Data Controllers/Fiduciaries.
• Quizzory is a Data Processor/Service Provider.
Quiz Creators must obtain consent from Participants as required by applicable law.
6. USER-GENERATED CONTENT (UGC)
Users retain ownership of content they create. By using our service, you grant Quizzory a limited, non-exclusive license to store and process the content solely to operate the platform.
Users must not upload content that is illegal, harmful, abusive, defamatory, hateful, infringing, or violates privacy rights.
Quizzory may remove content or suspend accounts for violations.
7. ADVERTISEMENTS
Quizzory is an advertising-supported service. Advertisements may be displayed on designated pages of the platform, including after a participant completes a quiz. These advertisements are designed to be non-intrusive and do not interfere with quiz content, answer submission, or the participant experience.
Advertisements may be shown on all plans, including free and paid plans. A paid subscription unlocks premium features but does not by itself remove advertisements.
This advertising policy is effective from June 19, 2026. By continuing to use Quizzory on or after this date, you agree to this policy.
8. SUBSCRIPTIONS, BILLING & REFUNDS
Quizzory offers free and paid subscription plans. Paid plans auto-renew unless cancelled.
• Billing occurs in advance.
• Taxes may apply.
• Refunds are not issued for partial periods, add-ons, or unused time.
• Cancelling stops the next billing cycle but does not refund the current cycle.
9. ACCEPTABLE USE POLICY
You agree NOT to:
• Use the service for spam or unsolicited communication.
• Conduct fraudulent examinations, assessments, or competitions.
• Collect sensitive personal data without consent.
• Attempt to hack, reverse-engineer, misuse APIs, or disrupt the service.
• Upload malware or harmful scripts.
• Violate any applicable laws.
10. API TERMS
Quizzory may offer APIs for automation and integration. By using APIs, you agree to:
• Respect rate limits.
• Not use APIs for scraping or abusive purposes.
• Secure your API keys.
Quizzory may revoke API access at any time for misuse.
11. INTELLECTUAL PROPERTY
Quizzory retains all rights to its platform, interface, algorithms, templates, branding, and design. Users retain rights to the quizzes, content, and data they create.
12. SERVICE AVAILABILITY & DISCLAIMER
We aim for 99.5% uptime but do not guarantee uninterrupted service. Maintenance, updates, outages, or unforeseen events may impact availability.
Services are provided “as is” without warranties of any kind.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Quizzory shall not be liable for:
• Loss of data
• Loss of profits
• Indirect, incidental, or consequential damages
Our total liability shall not exceed the amount paid by the User in the past 12 months.
14. INDEMNITY
Users agree to indemnify and hold Quizzory harmless from claims arising from:
• Illegal or harmful content uploaded
• Violation of data protection laws
• Misuse of Quizzory services
• Disputes with Participants or Respondents.
15. TERMINATION & SUSPENSION
Users may delete their accounts at any time. Quizzory may suspend or terminate accounts that violate these Terms, cause risk, or misuse the service.
16. GOVERNING LAW, JURISDICTION & ARBITRATION
These Terms are governed by the laws of India.
Disputes shall be resolved exclusively in Hyderabad, Telangana.
All disputes shall be settled through binding arbitration under the Arbitration & Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad.
17. MODIFICATIONS TO TERMS
We may update these Terms. Material changes will be communicated through email or platform notifications. Continued use constitutes acceptance.
